These Terms and Conditions ("Terms") govern your use of the ServiceCart mobile application and services provided by V SQUARE CORPORATION ("ServiceCart," "we," "us," or "our"). By accessing or using the ServiceCart platform, you agree to comply with these Terms. If you do not agree with these Terms, please do not access or use our platform.
1. Use of Service
1.1 Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement to use our services. By accessing or using ServiceCart, you represent and warrant that you meet these eligibility requirements.
1.2 Account Registration: You may be required to create an account to access certain features of ServiceCart. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
1.3 Acceptable Use: You agree to use ServiceCart solely for lawful purposes and in accordance with these Terms. You shall not use our platform in any manner that violates applicable laws or infringes upon the rights of others.
1.4 Indian Laws Compliance: By using ServiceCart in India, you agree to comply with all applicable Indian laws, including but not limited to the Information Technology Act, 2000, and any rules or regulations issued thereunder.
2. Service Booking and Payments
2.1 Service Booking: ServiceCart allows you to book home and beauty services through our platform. By booking a service, you agree to abide by our Cancellation Policy and Refund Policy, as outlined separately.
2.2 Payment: You agree to pay the applicable fees for the services booked through ServiceCart. Payment processing is facilitated through third-party payment processors, and you consent to the collection and processing of your payment information by such processors.
2.3 GST Compliance: All fees displayed on ServiceCart are inclusive of Goods and Services Tax (GST) as per Indian tax regulations.
3. Intellectual Property Rights
3.1 Ownership: ServiceCart and its content, including but not limited to text, graphics, logos, and software, are owned or licensed by ServiceCart and are protected by intellectual property laws.
3.2 License: Subject to these Terms, ServiceCart grants you a limited, non-exclusive, revocable license to access and use our platform for its intended purpose. You shall not modify, reproduce, distribute, or create derivative works based on ServiceCart.
4. Privacy Policy
4.1 Privacy: Your use of ServiceCart is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using ServiceCart, you consent to the practices described in our Privacy Policy.
5. Disclaimer of Warranties
5.1 As-Is Basis: ServiceCart is provided on an "as-is" and "as-available" basis, without any warranties of any kind, express or implied. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
6.1 Exclusion of Liability: In no event shall ServiceCart or its affiliates, directors, officers, employees, or agents be liable to you or any third party for any indirect, consequential, incidental, special, or punitive damages arising out of or in connection with your use of ServiceCart.
7. Governing Law and Dispute Resolution
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
7.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or your use of ServiceCart shall be resolved exclusively through binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996. The arbitrator's decision shall be final and binding.
8. Changes to Terms
8.1 Modification: ServiceCart reserves the right to modify or revise these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our platform. Your continued use of ServiceCart after the posting of revised Terms constitutes your acceptance of the changes.
